Kelly Rutherford Custody Update: Celeb Mom Talks About Divorce & Kids, 'Daniel As Subtly Verbally Abusive'

Kelly Rutherford is an epitome of an ideal mother,  that's how friends and family close to her describe the "Gossip Girl" star. Unfortunately, motherhood is a struggle to the 46-year-old actress as she battles over her children's custody.

Rutherford "was a very devoted and passionate mother. Her first priority was always her kids, "Upper East Side" show-runner Stephanie Savage said. The other actors whom Rutheford worked with when she was still with her kids described her as an amazing and caring mom, Vanity Fair reports.

The "Generation" star was simply the type of mom anyone wants to have. Unfortunately, after  her divorce things get pretty complicated at her disadvantage. In 2012, following a controversial custody battle, her two children were  sent to live with their Geman-citizen dad Daniel Giersh  in Monaco.

The Los Angeles court and New York court have already declined jurisdiction over her case. Last August, when her two children arrived to spend their vacation with her, Rutherford took a risky decision. She did not abide the June 22 agreement made in the Monacco court ordering her to return the children to Giersch after a five-week summer vacation.

Rutherford contended that the court has dropped its jurisdiction, no American court can compel her to return Hermes and Helena back in Monacco. Unfortunately her husband thinks otherwise and she was accused of child abduction.

Within days, the New York court ordered her to turn over the children's American passport and send them back to Monacco immediately.

Now, Rutherford who simply wants to be with her children is at a complete disadvantage. Her next trip to Monacco is for a court hearing. Another Monacco court hearing is scheduled on Oct. 26, which would seal her fate.

According to JustJared, the mom-of-two has finally talked about the painful details of her divorced and custody battle with ex Giersch, whom she shared Hermes, 8, and Helena, 6.

"Daniel was subtly verbally abusive," the actress told Vanity Fair. "He was trying to alienate me from everyone in my life-my parents, my brother."

Kelly stressed that she's not after Daniel's money but want them both to be great parents to their children but he gave her a hard time.

"I wasn't asking for full custody. Daniel made me go through a custody evaluation while I was pregnant," Rutherford added. "He sued me like he'd sued Google. He served me custody papers right up until I went into labor."

Kelly said that her son, Hermes is tired of going back and forth. She recognized the years they lost and vowed to fight for her children. "My children and I have lost years of dailiness. How do you get those years back? There is no way I am not going to fight to get my children back."
