Halle Berry-Olivier Martinez Split: Actress Files For A Second Time; Drama Over Spousal Support, Child Custody

More details are emerging about why Halle Berry and Olivier Martinez have decided to call it quits. It looks like things will still get ugly for this divorcing ex-couple.

TMZ was able to obtain the divorce documents Monday and learned that Berry filed a day ahead of her ex-husband using the pseudonym Hal Maria. The news outlet stated that the actress used an alias for privacy reasons and it's still not clear whether this will be considered legal.

But it shouldn't matter anymore as TMZ also obtained another court document that showed the actress filing for divorce a second time. This time, she used her real name and she's also seeking for joint custody of their two-year-old son Maceo.

Meanwhile, Olivier also filed for divorce this week, making it the third petition filed for both couples. According to Daily Mail, the actress wanted to be the petitioner in the divorce, hence she filed first, but Olivier allegedly wanted to challenge this.

The news outlet also indicated that things may not go smoothly with the settlement, as the husband would like the court to address spousal support despite having a prenup. Then there's the matter of child custody with the actress wanting Olivier to seek permission first in the event that he would like to bring Maceo outside of California.

Olivier is a native of France and during the early part of their marriage, the couple had been keen on living abroad to raise their boy, the Daily Mail stated. But plans changed as Halle had to fight for custody of her older daughter, Nahla, 6, with ex-partner Gabriel Aubry. Halle and Olivier had to relocate to California because of this.

According to People, Olivier has an "explosive temper," which Halle could use against him. "She can use that as grounds to claim he has a propensity for violence, but she really has to prove the violence directly affects the child," Robert Brandt, who specializes in California family law, told the news outlet.

But another source told Us Weekly that Halle and Olivier are "two very hot-headed people." Their years together involved "lots of screaming and fighting," prompting the insider to say that this could really become a bitter divorce.

Halle met Olivier while filming the movie "Dark Tide" back in 2010 and they were married in 2013 after a secret engagement. This is the third failed marriage for the actress whose other ex-husbands include David Justice, a baseball player, and Eric Benet, the R&B singer. She has no children with these men and she did not marry the father of Nahla.
