Lindsay Lohan vs. 'Grand Theft Auto 5': Actress Can Now Pursue Lawsuit Against Rockstar [Photos]

A prosecutor allowed Lindsay Lohan to pursue her lawsuit against "Grand Theft Auto 5" creator, Rockstar. "Grand Theft Auto 5" allegedly features Lindsay Lohan's likeness in the images of one of the game's character, Jonas.

According to Inquisitr, Joan Kennedy's, the New York Supreme Court judge, order on Friday, the jurist gathers all the available conclusions in favor of Lindsay Lohan this time. Kenned added that she can't only depend of the Take-Two Interactive's given evidence in contrary of Lindsay Lohan's complaint.

Also, In a ruling made by Kennedy, she noted that whenever a prosecutor needs to decide if the charge should be pursued or dismissed, "the complaint must be constructed in the light most favorable to the plaintiff, and all factual allegations must be accepted as true," as cited by BGR.

Lindsay Lohan's group of legal personnel, on the other hand, is accusing Rockstar for using their client's image without permission as the figure of "Grand Theft Auto 5's" snaps in 2007. However, "Grand Theft Auto 5" began its development between 2009 and 2013, which is the same time when Lindsay Lohan is in and out of courtrooms and jail.

Inquisitr added that Lindsay Lohan's lawful team managed to present the pictures they referring to, which  resembled the photos used in "Grand Theft Auto 5." Meanwhile, Lindsay Lohan's accusation against "Grand Theft Auto 5" and Rockstar looks quite outstretched, BGR reported.

Lindsay Lohan did not just filed a complaint against "Grand Theft Auto 5" for using her images, she also filed a complaint in July 2014 against Take-Two Interactive. Allegedly, Take-Two Interactive used Lindasy Lohan's pictures in billboards, mugs, posters, buses, websites, and other "Grand Theft Auto 5" merchandises and advertisements.

To recall, Lindsay Lohan filed a lawsuit against the rapper Pitbull in 2011 for dragging her name to his song, "Give Me Everything." The single has a lyrics that goes like, "So, I'm tiptoein', to keep flowin. I got it locked up, like Lindsay Lohan."
