'Making A Murderer' Season 2 Spoilers, News: Brendan Dassey Free By Thanksgiving, Wisconsin Prosecutors Fighting To Keep Him Locked Up

A judge has ordered that "Making a Murderer" subject Brendan Dassey, 27, should be released from prison the soonest. It is expected that he will be out before Thanksgiving so that he could spend this with family after 10 years. But Wisconsin state prosecutors are fighting the order so that Dassey stays in prison.

The conviction of "Making a Murderer" subject Brendan Dassey was overturned by the courts last August. On Monday, US magistrate judge William Duffin said that he should be freed pending certain conditions, as outlined on Tallahassee Democrat's report.

Brendan Dassey's incarceration was documented in the first season of Netflix's "Making a Murderer." It showed that Wisconsin police took advantage of him so that he ended up confessing to helping in the murder of Teresa Halbach.

According to CNN, court documents showed that Brendan Dassey was of "low average" IQ and young, thus the police was able to manipulate his confession, as seen on "Making a Murderer." It was because of this coercion that the court overturned his conviction in 2007.

The attorney of the "Making a Murderer" subject said that he intends to have Brendan Dassey out by Thanksgiving, Nov. 24. He's also making arrangements for the ex-convict's acclimation to society after being incarcerated for over a decade, according to Yahoo.

But no sooner had the judge ordered Brendan Dassey's release, state prosecutors said that they won't allow this to happen and the "Making a Murderer" subject will have to remain in prison. The state has actually appealed the overturn and will also lodge an emergency motion for Dassey's stay.

The controversial "Making a Murder" documentary, which was written, produced and directed by Laura Ricciardi and Moira Demos for Netflix, was centered on Steven Avery. His nephew, Brendan Dassey, was tagged as his accomplice.

"Making a Murderer" primary subject Steve Avery is also appealing his case in court. He has a new lawyer working to get him freed from prison as well. Production for the documentary's second season has started since August.
